Terms and Conditions

By downloading, installing, accessing, or using the Mother Tongue application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you must immediately cease using the Service and uninstall the application from your device.

To use our Service, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete information during registration

If you are under 18 years of age, you must have permission from a parent or legal guardian to use the Service, and they must agree to these Terms on your behalf.

3.1 Account Creation

Some features of the Service require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized use of your account or any other security breach at security@africantongues.com.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the application on your personal devices
• Access and use the Service for personal, non-commercial purposes
• Use any content provided through the Service as intended

When using our Service, you agree NOT to:

6.1 Your Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the Service.

6.2 Content Standards

You are solely responsible for your User Content and must ensure it:

• Does not infringe on any third-party intellectual property rights
• Does not contain false or misleading information
• Complies with all applicable laws and regulations
• Does not contain malware, viruses, or harmful code

6.3 Translation Contributions

If you contribute translations or language data to improve our AI models, you grant us a perpetual, irrevocable license to use such contributions to enhance the Service for all users.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Mother Tongue Inc. and its licensors.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.1 Free and Paid Services

The core translation features are free. We offer optional "Pro" subscription plans with additional features including unlimited offline packs and API access.

9.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method automatically
• Price changes will be notified 30 days in advance

9.3 Cancellation

You may cancel your subscription at any time through your account settings or the respective app store. Cancellation will take effect at the end of the current billing period.

Translation services should not be used as the sole source for critical communications, legal documents, or medical information.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFRICAN MOTHER TONGUES INC. SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Any translation errors or inaccuracies

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

You agree to defend, indemnify, and hold harmless African Mother Tongues Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of any fees owed
• Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. You may request deletion of your account data by contacting us at privacy@africantongues.com.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Notification of changes will be made through:

• Email notification to the address associated with your account
• In-app notification
• Notice posted on our website

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
